1. About this Privacy Notice

This Privacy Notice explains how Tiberius Capital Technologies Limited, trading as StandOn (“StandOn”, “we”, “us” or “our”), collects, uses, shares, stores and protects personal information.

It applies to:

  • the StandOn web application;
  • the GetStandOn.com website;
  • StandOn accounts;
  • our communications with you;
  • our sailing-school and partner relationships;
  • enquiries submitted through our website;
  • support, privacy and complaint communications; and
  • other interactions with StandOn where this Privacy Notice is provided or referred to.

This Notice should be read alongside the StandOn App Terms of Use and any other privacy information or consent wording presented to you when we collect or use your information.

Tiberius Capital Technologies Limited is the controller of the personal information described in this Privacy Notice unless we expressly state otherwise.

3. The information we collect

The information we collect depends on how you interact with StandOn.

3.1 Account information

When you create or use a StandOn account, we may process:

  • your email address;
  • your password through our authentication provider;
  • your optional display name;
  • your timezone;
  • your internal user/account identifier;
  • account creation date;
  • last sign-in information;
  • account status;
  • Premium or other entitlement information; and
  • information about codes, promotions or account benefits applied to your account.

StandOn does not have access to your password in readable form. Password authentication is handled by our authentication infrastructure and passwords are stored using one-way cryptographic protection.

Your timezone may be obtained from your browser and is used for features that depend on dates or daily usage periods. If this is unavailable, StandOn may use a default timezone.

3.2 Authentication, device and security information

When you sign in or interact with our systems, our infrastructure and authentication providers may process information including:

  • IP address;
  • browser and device information;
  • session information and authentication tokens;
  • sign-in dates and times;
  • last sign-in time; and
  • information required to maintain and secure your session.

We use this information to authenticate users, maintain sessions, protect accounts, investigate security or misuse issues, troubleshoot problems and protect the integrity of StandOn.

StandOn does not currently use login IP addresses to determine your geographic location.

3.3 Learning and usage information

When you use StandOn's learning features, we record information about your activity so that we can provide the service.

This may include:

  • learning and quiz sessions;
  • the learning mode used, such as Practice, Focus or Test me now;
  • topics and difficulty levels;
  • questions shown to you;
  • questions attempted;
  • answers submitted;
  • whether answers were correct or incorrect;
  • scores;
  • dates and times of activity;
  • session start and completion information;
  • daily usage counts; and
  • other learning activity necessary to provide StandOn's features.

We also calculate information from your learning activity, including:

  • overall learning progress;
  • knowledge/progress measures;
  • revision freshness or decay;
  • areas that may benefit from further practice;
  • Focus recommendations; and
  • other progress information used to operate StandOn's learning features.

These calculations are based on automated rules. They are not artificial-intelligence or machine-learning decisions and do not produce decisions with legal or similarly significant effects on you.

StandOn does not determine whether you are competent to sail, whether you have passed an RYA or other sailing course, or whether you should receive any qualification or certification.

3.4 Legal and consent records

We keep records relating to legal documents and choices you make within StandOn.

These may include:

  • the version of the StandOn App Terms of Use you accepted;
  • the version of the Privacy Notice you acknowledged;
  • the date and time of acceptance or acknowledgement;
  • the method or context in which it was given;
  • marketing choices and changes to those choices;
  • sailing-school linking permissions;
  • the version of school-sharing wording agreed to; and
  • the date and time of those choices.

These records help us administer your choices and demonstrate what information or terms applied at a particular time.

3.5 Sailing-school information and account linking

If you voluntarily link your StandOn account to a participating sailing school, we may process:

  • the school you linked to;
  • the school or referral code used;
  • the date of the link or referral;
  • referral information;
  • your permission to share information with the school;
  • the version of the permission wording you agreed to;
  • related commercial or commission information; and
  • information necessary to administer the relationship between you, StandOn and the school.

Linking your account to a sailing school is optional.

Where StandOn makes learner information available to a linked school, the information may include:

  • your name;
  • your email address;
  • your overall learning progress;
  • the amount you paid for relevant StandOn products or access; and
  • relevant learning and usage information.

Relevant learning and usage information may include topics studied, questions attempted, answers and results, scores, learning sessions, progress and freshness measures, activity dates or frequency, and use of relevant learning modes or features.

We do not treat unrelated account or security information as school learning data. Schools are not given access through this feature to information such as:

  • your password or authentication credentials;
  • login IP addresses;
  • browser/device authentication information;
  • your Terms or Privacy Notice history;
  • your marketing preferences;
  • private support correspondence; or
  • internal security or administration records.

Authorised school representatives may also be given access to relevant referral and commercial information, such as the value of a qualifying purchase, referral commission, and commission status, where required to administer the school's partnership with StandOn.

We rely on your consent for the sharing of learner information with a school where consent is the applicable lawful basis. You can withdraw that permission by asking us to unlink your account from the school. Contact support@getstandon.com or privacy@getstandon.com.

Withdrawing permission or unlinking your account stops future sharing through StandOn. It does not retrospectively affect processing that was lawful before withdrawal, and it may not remove information that a school has already lawfully received and independently retains.

Some school-sharing functionality described above may be introduced or expanded as StandOn's school-partner functionality develops. We will not use this Notice to authorise materially different sharing without updating our privacy information and, where required, obtaining appropriate permission.

3.6 Purchases, Premium, discounts and promotions

StandOn may process information relating to purchases and paid or promotional access, including:

  • the product or entitlement;
  • amount paid;
  • currency;
  • transaction or reference identifier;
  • purchase date;
  • payment status;
  • refund information, where applicable;
  • discounts;
  • promotion or referral codes;
  • Premium entitlement;
  • the source of an entitlement; and
  • associated school referral or commission information.

StandOn does not currently have a live payment-processing provider. If payment functionality is introduced, payments may be processed by an authorised third-party payment service provider.

The payment provider may process information necessary to complete the payment. StandOn may receive transaction information required to provide the purchased product, maintain records, administer refunds or disputes, calculate commissions and meet accounting or legal obligations.

We will update our processing arrangements as necessary when payment functionality is introduced.

3.7 Marketing preferences

StandOn marketing is optional and is off by default.

If you choose to receive StandOn marketing, we record your choice and may use your contact information to send occasional communications about:

  • StandOn product updates;
  • new features or content;
  • offers; and
  • relevant StandOn news.

Your StandOn marketing choice does not authorise unrelated third parties, sailing schools or other partners to send you their own marketing.

You can withdraw your marketing choice at any time through your StandOn Account settings.

We may retain a record of your marketing choices and withdrawals where reasonably necessary to respect and demonstrate those choices.

StandOn does not currently have a marketing-email provider connected. If we introduce one, an appropriate service provider may process the contact information needed to deliver those communications on our behalf.

3.8 Website enquiries and HubSpot forms

GetStandOn.com currently uses embedded HubSpot forms for:

  • general contact enquiries; and
  • sailing-school or partnership enquiries.

Depending on the form you use, we may collect information such as:

  • your name;
  • email address;
  • school or organisation name;
  • website;
  • country;
  • approximate number of students;
  • courses offered; and
  • the contents of your message or enquiry.

HubSpot processes these form submissions on our behalf as our website forms/CRM service provider.

Submitting a Contact or Sailing School / Partnership Interest form does not automatically opt you into general StandOn marketing.

3.9 Support, complaints, privacy requests and feedback

If you contact us, we may process:

  • your name and contact details;
  • account information needed to identify or assist you;
  • the content of your correspondence;
  • attachments or other information you choose to provide;
  • information required to investigate your request; and
  • our response and actions taken.

This includes support enquiries, complaints, privacy requests, corrections, content concerns and feedback about StandOn.

We may use feedback and correction reports to investigate issues, respond to you, improve StandOn and maintain the accuracy and quality of our content.

3.10 School and business contact information

If you represent a sailing school, supplier, partner or other organisation, we may process professional contact information such as:

  • your name;
  • organisation;
  • role;
  • business email address;
  • website;
  • contact information;
  • correspondence; and
  • information relating to our business relationship.

4. Information we do not intentionally collect

StandOn is not designed to collect special-category or similarly sensitive personal information such as information about:

  • racial or ethnic origin;
  • political opinions;
  • religious or philosophical beliefs;
  • trade-union membership;
  • genetic or biometric identification;
  • health;
  • sex life or sexual orientation; or
  • criminal offences.

Please avoid providing sensitive personal information in display names, website forms, support messages or other free-text communications unless it is genuinely necessary for your request.

If you voluntarily provide sensitive information, we will only process it to the extent reasonably necessary to deal with your communication and where permitted by applicable law.

StandOn does not collect precise GPS location information through the app.

5. How and why we use personal information

We use personal information for purposes including:

  • creating, authenticating and maintaining StandOn accounts;
  • providing learning functionality;
  • recording learning activity and progress;
  • calculating progress, freshness and areas for further practice;
  • providing Focus and other personalised learning functionality;
  • enforcing free usage limits;
  • providing Premium and other entitlements;
  • administering promotions, discounts and codes;
  • administering sailing-school links and referrals;
  • sharing information with a linked sailing school where you have agreed to that sharing;
  • administering school commissions and partnerships;
  • processing and maintaining purchase records;
  • providing customer support;
  • responding to privacy requests and complaints;
  • communicating important service or account information;
  • sending optional marketing where you have chosen to receive it;
  • maintaining legal and consent records;
  • protecting accounts and StandOn's systems;
  • detecting and investigating fraud, misuse or security incidents;
  • troubleshooting and maintaining the service;
  • improving StandOn and correcting content;
  • administering our business;
  • establishing, exercising or defending legal claims; and
  • complying with legal, regulatory, tax and accounting requirements.

6. Our lawful bases

UK data-protection law requires us to have a lawful basis for processing personal information.

Depending on the processing, we may rely on:

Contract

We process information where necessary to provide StandOn and perform our contract with you.

This includes processing needed to create and maintain your account, provide learning functionality, record progress, provide account features, apply usage limits and provide entitlements you request.

Legitimate interests

We may process information where necessary for our legitimate interests or those of another person, provided those interests are not overridden by your rights and interests.

These interests may include:

  • operating and administering StandOn;
  • maintaining and improving the service;
  • account and system security;
  • fraud and misuse prevention;
  • troubleshooting;
  • maintaining appropriate audit and evidential records;
  • administering codes, referrals and partnerships;
  • protecting our legal rights; and
  • responding effectively to users and business contacts.

Consent

We rely on consent where appropriate, including for:

  • optional StandOn marketing; and
  • sharing relevant learner information with a sailing school that you voluntarily link to your account.

Where we rely on consent, you can withdraw it at any time. Withdrawal does not affect processing that was lawful before you withdrew consent.

Legal obligation

We may process information where necessary to comply with a legal or regulatory obligation, including applicable accounting, tax, data-protection or other legal requirements.

Legal claims and other lawful grounds

Where applicable, we may also process information where necessary to establish, exercise or defend legal claims or where another lawful basis or condition under applicable data-protection law applies.

7. Automated processing and AI

StandOn uses automated rules to operate parts of the learning experience.

For example, we may automatically:

  • calculate progress;
  • calculate learning freshness or decay;
  • identify areas that may benefit from further practice;
  • select Focus areas;
  • apply daily usage allowances; and
  • determine whether an account has the relevant entitlement to access a feature.

These are rule-based processes.

StandOn does not currently use artificial intelligence or machine learning to process your personal information, learning history, feedback or communications.

We do not currently send your personal information or learning data to an AI provider or use it to train an AI model.

StandOn does not use automated processing to make decisions about your sailing competence, qualifications or course outcomes, and the automated processing described above does not have legal or similarly significant effects on you.

If this materially changes, we will update our privacy information as appropriate.

8. Who we share personal information with

We do not sell personal information to advertisers or data brokers.

We do not currently use personal information for behavioural advertising or provide it to third parties for their own unrelated marketing.

We may share or make personal information available to the following categories of recipients where necessary.

Lovable / Lovable Cloud

StandOn currently uses Lovable/Lovable Cloud infrastructure for services including hosting, database functionality, authentication, storage, technical infrastructure and authentication-related emails.

These services process information as necessary to operate StandOn.

HubSpot

We use HubSpot to process and manage submissions from the Contact and Sailing School / Partnership Interest forms on GetStandOn.com.

Linked sailing schools

If you voluntarily link your account to a participating sailing school and agree to the relevant sharing, we may make the learner and commercial information described in section 3.5 available to authorised representatives of that school.

Payment providers

If StandOn introduces payment functionality, authorised payment providers may process information required to complete transactions and provide related payment services.

Communications and operational providers

We may use appropriate providers for services such as email delivery, communications, customer support, security, hosting, infrastructure and other operational functions.

Professional advisers

We may disclose information where reasonably necessary to lawyers, accountants, auditors, insurers and other professional advisers.

Authorities and legal recipients

We may disclose information where reasonably necessary to:

  • comply with applicable law or regulation;
  • respond to a court order or lawful request;
  • establish, exercise or defend legal claims;
  • investigate fraud, misuse or security incidents; or
  • protect StandOn, our users or others.

Business transfers

If Tiberius Capital Technologies Limited or StandOn is involved in a merger, acquisition, financing, restructuring, sale of assets or similar transaction, relevant information may be disclosed to advisers, potential counterparties and any successor organisation where reasonably necessary and subject to appropriate safeguards.

This is not a sale of personal information to advertisers or data brokers.

9. International processing and transfers

Tiberius Capital Technologies Limited is based in the United Kingdom, but some of the service providers and infrastructure used to operate StandOn process information in other countries.

For example, StandOn's current database infrastructure is hosted in Frankfurt, Germany.

Lovable, HubSpot and other current or future service providers may process information in the UK, European Economic Area or other countries depending on their infrastructure and subprocessors.

Where personal information is transferred outside the United Kingdom and UK data-protection law requires safeguards, we will use an appropriate lawful transfer mechanism.

Depending on the circumstances, this may include:

  • processing in a country or territory covered by UK adequacy regulations;
  • appropriate contractual or other safeguards recognised under UK data-protection law; or
  • another lawful transfer mechanism or exception where applicable.

10. Cookies, sessions and similar technologies

StandOn uses browser storage, cookies and similar technologies where necessary to operate, deliver and protect our website and application.

Within the StandOn application, browser storage and similar technologies may be used to maintain authenticated sessions and keep users signed in. These technologies may be linked to your account where required to provide authentication and account functionality.

GetStandOn.com uses limited cookies and similar technologies for hosting, security and requested website functionality.

Our Contact and Sailing School / Partnership Interest pages use embedded HubSpot forms. When these forms are loaded or used, HubSpot and service providers used by HubSpot may use technologies required to display, operate and protect the forms, including spam and bot-protection technologies such as Google reCAPTCHA.

At the date of this Notice, StandOn does not intentionally use advertising pixels, behavioural advertising trackers, session replay or behavioural analytics within the StandOn app or on GetStandOn.com.

We do not currently install HubSpot's general visitor-tracking code on GetStandOn.com and do not intentionally use HubSpot visitor-tracking cookies for website analytics.

Further information about cookies and similar technologies used on GetStandOn.com is available in our Cookie Notice.

If we introduce non-essential analytics, advertising or similar technologies in the future, we will review the applicable transparency and consent requirements before using them and obtain consent where required.

11. How long we keep information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including applicable legal, accounting, security and evidential requirements.

Our normal approach is as follows.

Account and learning information

Ordinary account and learning information is generally retained while your StandOn account remains active.

If you delete your account, this information is deleted in accordance with the account-deletion process described below, subject to the limited records that we retain in anonymised form or where continued retention is otherwise lawfully required.

Financial and commercial records

Relevant purchase, payment, discount, promotion, referral and commission records may normally be retained for up to seven years where necessary for accounting, tax, fraud prevention, dispute resolution or other legitimate legal or commercial purposes.

Following account deletion, these records may be retained in anonymised form where identification is no longer necessary.

Legal and consent evidence

Relevant evidence of:

  • App Terms acceptance;
  • Privacy Notice acknowledgement; and
  • school-linking permission

may be retained in anonymised form for up to seven years after account deletion or the relevant relationship ends.

This may include the document or consent type, version, date/time and method, linked only to an anonymous deletion reference rather than your active account, name or email address.

Administration, security and audit records

Relevant administration, security, fraud-prevention and audit records may normally be retained for up to seven years where reasonably necessary for security, accountability, fraud prevention, disputes or legal purposes.

Where appropriate, these records may be minimised or anonymised.

Support and ordinary correspondence

Ordinary support correspondence may normally be retained for up to 24 months after the last meaningful interaction.

Information may be retained for longer where the correspondence concerns a complaint, dispute, payment, security incident, legal claim or another matter requiring longer retention.

Website enquiries

General website enquiries may normally be retained for up to 24 months after the last meaningful interaction.

Sailing-school or partnership enquiries that do not develop into an ongoing relationship may normally be retained for up to 24 months after the last meaningful interaction.

Where an ongoing commercial or partnership relationship develops, relevant information may be retained for the duration of that relationship and afterwards in accordance with applicable commercial, accounting and legal retention requirements.

Longer retention where necessary

We may retain information for longer than the normal periods above where reasonably necessary to:

  • comply with a legal or regulatory obligation;
  • deal with a complaint or dispute;
  • establish, exercise or defend legal claims;
  • investigate fraud, misuse or security incidents; or
  • meet another lawful requirement or permitted purpose.

When information is no longer required, we will delete or anonymise it as appropriate.

12. What happens when you delete your StandOn account

You can delete your StandOn account through the Account section of the app.

Account deletion is permanent.

When your account is deleted, StandOn deletes the active account information and learning information associated with it, including, as applicable:

  • your authentication account and email address;
  • profile and display name;
  • active sailing-school link;
  • authentication sessions;
  • learning sessions;
  • answers;
  • questions shown;
  • daily usage records;
  • learning progress and freshness state;
  • marketing preferences and history;
  • Premium and other entitlements;
  • account roles; and
  • account-linked feedback.

Your progress and learning history cannot be restored after deletion.

Creating a new StandOn account later, including with the same email address, does not restore your previous account, Premium entitlement, learning history or purchases.

Deleting your account does not itself create an entitlement to a refund, subject always to any rights you may have under applicable law.

Records retained anonymously after deletion

Certain records may need to remain for accounting, legal, evidential, anti-abuse or partnership purposes.

Where appropriate, StandOn anonymises these records by replacing the account relationship with a random deletion reference that is not linked to your name, email address or active account.

Depending on your use of StandOn, anonymised records may include:

  • purchase records;
  • discount redemptions;
  • promotion redemptions;
  • school commissions;
  • school referrals;
  • school-link permission records;
  • App Terms acceptance records;
  • Privacy Notice acknowledgement records; and
  • the anonymous account-deletion record.

Relevant administrative/audit records may also retain a former internal user identifier where that identifier no longer links to an identifiable StandOn account or person.

Sailing schools after deletion

Deleting your account removes your active StandOn link to a sailing school and stops future sharing through that account.

Historical referral, commission and permission records may be retained in anonymised form as described above.

If a sailing school previously received information lawfully and holds it independently, StandOn may not be able to delete that school's independent copy. You may need to contact the school directly regarding information it controls.

13. Your rights

Depending on applicable data-protection law and your circumstances, you may have rights including the right to:

  • ask whether we process your personal information;
  • access personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of personal information;
  • request restriction of processing;
  • object to certain processing;
  • receive certain information in a portable format;
  • withdraw consent where processing is based on consent; and
  • complain to a data-protection supervisory authority.

These rights are not absolute and may be subject to conditions, exemptions or competing legal obligations.

Using your rights in StandOn

Some choices can be managed directly:

  • Display name: change it through your Account settings.
  • Marketing preference: change it through your Account settings.
  • Delete account: use the account-deletion functionality in the Account section.

For other requests, including:

  • obtaining a copy of your information;
  • changing your account email address;
  • asking us to unlink your sailing school;
  • withdrawing school-sharing permission;
  • correcting information that cannot be changed in the app; or
  • exercising another data-protection right,

You can also contact support@getstandon.com for account assistance, including requests to unlink a sailing school.

Where we rely on consent, withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

We may need to verify your identity before fulfilling certain privacy requests.

You also have the right to complain to the UK Information Commissioner's Office (ICO).

You do not have to complain to us before contacting the ICO.

If you are located outside the UK, you may also have rights to contact another competent data-protection authority under applicable local law.

15. Children and age requirement

StandOn accounts are intended for people aged 16 or over.

Users confirm when creating an account that they meet the applicable minimum-age requirement.

We do not currently independently verify a user's age and do not require a date of birth solely for this purpose.

We do not knowingly offer StandOn accounts to children under 16.

If we become aware that a person under 16 has created an account or provided personal information contrary to our age requirement, we may take appropriate steps to close the account and delete the information, subject to any information we are required or permitted to retain.

16. Security

We use technical and organisational measures intended to protect personal information appropriately for the nature of the service.

Current measures include, where applicable:

  • encrypted HTTPS connections;
  • authentication controls;
  • one-way password protection through our authentication provider;
  • database access controls;
  • row-level access restrictions designed to limit users to their own information;
  • role-based administrator access;
  • server-side checks for sensitive actions;
  • restrictions on modification of certain financial and legal records;
  • audit records for certain significant administrative actions; and
  • transactional account-deletion controls designed to prevent partial deletion.

No internet service or storage system can guarantee absolute security.

If you believe your StandOn account or personal information may have been compromised, contact support@getstandon.com.

17. Internal access

Authorised StandOn personnel may access personal information where reasonably necessary to:

  • operate and support StandOn accounts;
  • respond to support, privacy or complaint requests;
  • administer Premium, codes and sailing-school links;
  • administer school partnerships, referrals and commissions;
  • investigate technical, security, fraud or misuse issues;
  • maintain and improve StandOn;
  • manage legal or regulatory obligations; and
  • protect StandOn's rights and systems.

Access is restricted using roles, database permissions and other access controls.

18. Changes to this Privacy Notice

We may update this Privacy Notice from time to time to reflect:

  • changes to StandOn;
  • new or changed features;
  • changes to our service providers;
  • changes to our data-processing activities;
  • legal or regulatory developments; or
  • improvements to how we explain our privacy practices.

The current version and last-updated date will be shown at the top of this Notice.

Minor or administrative changes may simply be published as an updated version.

Where a change materially affects how we use or share personal information, we will provide additional notice where appropriate.

StandOn may require account holders to acknowledge a materially updated Privacy Notice before continuing to use the service.

Where applicable law requires fresh consent for a new or materially changed processing activity, we will seek that consent rather than treating continued use of StandOn as consent.

We may retain evidence of previous versions and acknowledgements where reasonably necessary.

19. Future features and service providers

StandOn will continue to develop.

We may introduce or change features, payment providers, communications providers, hosting or infrastructure providers, school functionality and other services.

We do not use this Privacy Notice as blanket permission for materially different future uses of personal information.

Where a new feature does not materially change the nature or purpose of our processing, it may operate under this Notice.

Where a new feature introduces a materially new purpose, category of personal information, recipient or type of sharing, we will update our privacy information as appropriate and obtain consent where required.

Changing a service provider that processes information on our behalf does not necessarily change the purpose for which we use your information. We may appoint or replace appropriate processors without seeking consent for the appointment itself, subject to our data-protection obligations.

20. Users outside the United Kingdom

Tiberius Capital Technologies Limited is a UK company and this Privacy Notice is primarily written to explain our practices under applicable UK data-protection law.

StandOn may be accessible to users in other countries.

Depending on where you live or how applicable law applies, you may have additional mandatory privacy rights.

Nothing in this Privacy Notice is intended to limit rights that cannot lawfully be excluded under applicable data-protection law.
